A.P.Polo - "Fuck Frontex" - Hamburg (Germany). Abstract, colourful, contemporary visual representation of a border fence, symbolically reflecting the sad reality on the external border of the European Union. The European Border and Coast Guard Agency, also known as Frontex (from French: Frontières extérieures for "external borders"), is an agency of the European Union headquartered in Warsaw, Poland, tasked with border control of the European Schengen Area, in coordination with the border and coast guards of Schengen Area member states. Frontex was established in 2004 as the European Agency for the Management of Operational Cooperation at the External Borders and is primarily responsible for coordinating border control efforts. In response to the European migrant crisis of 2015–2016, the European Commission proposed on 15 December 2015 to extend Frontexs mandate and to transform it into a fully-fledged European Border and Coast Guard Agency. Several human rights organisations accuse Frontex of numerous & continuous human rights violations. Refugees from Senegal described in Report Mainz, broadcast on 5 October 2009, how their boat was seized at sea: "We only had three days to go when a police ship stopped us. They would not give us any water. They threatened to destroy our boat if we did not turn back immediately. We were almost thirsty and had corpses on board. Nevertheless we had to return to Senegal." Amnesty International, Pro Asyl and the Protestant Development Service have unanimously confirmed such reports upon request by Report Mainz. In several Turkish media, it was suspected that on 25 August 2011, border guards had possibly used firearms in the framework of the Frontex operation "Poseidon Land" against migrants at the Turkish-Greek land border. A group of migrants had tried to cross the Evros (Meriç) between Turkey and Greece in rubber dinghies when, according to reports from the Greek side, fire was opened on the boats. In October 2013, Frontex Director Ilkka Laitinen admitted that Frontex had pushed out refugee boats in the Mediterranean Sea several times a year and had deported refugees without asylum review procedures, even under threat of violence. The EU regulation on which this practice is based had already been condemned as a human rights violation by the European Court of Human Rights in 2012 and annulled. Laitinen said that these "push-back actions" were unacceptable, but statistics show that five to ten times a year there are cases where such suspicions need to be investigated. Numerous human rights organisations criticise Frontex in connection with military refugee defence measures in the Mediterranean region. A legal opinion by the European Center for Constitutional and Human Rights (ECCHR) concludes that EU border guards are also bound by refugee and human rights outside the territories of the EU states - including on the high seas beyond the 12-mile zone. Refugees apprehended in the middle of the sea therefore have the right to file an asylum application. They may also not be returned if they are at risk of persecution or ill-treatment. To prevent refugees from reaching the Mediterranean coast, Frontex also supports the establishment of camps in remote desert areas. In Libya, these include the Kufra Oases and Sabha. In November 2013, the agency was accused by ProAsyl of being directly involved in "push backs" from Greece to Turkey. In December 2014, following the incident involving the freighter Blue Sky M, Frontex claimed that the refugees on the ship had been abandoned by tugboats. However, reports that the ship was adrift without a driver off the coast of Corfu on 30 December 2014 proved to be false. Although refugees were on board, there was at no time any danger to their lives. The fake SOS message calling Italian rescuers on board had nothing to do with the condition of the ship and crew. In August 2019, media reports were published according to which Frontex tolerates human rights violations such as violent excesses at the EUs external borders by national border officials, and even violates human rights itself during deportation flights. The accusations are based on the evaluation of internal Frontex documents by the ARD political magazine report Munich, the daily newspaper The Guardian and the research centre Correctiv. A spokeswoman for the EU Commission promised to investigate the accusations. According to research published in April 2021 by Der Spiegel, Lighthouse Reports, Monitor and Libération, Frontex is defying the 2012 ruling of the European Court of Human Rights that refugees must not be returned to Libya (where they face torture and death). According to the research, when Frontex identified refugee boats in the Mediterranean through its own aerial reconnaissance, in most cases it did not notify civilian European rescue ships - even if they were closest to the position of the refugee boats - but the Libyan sea rescue control centre or the Libyan coast guard. According to an internal EU document, a total of 11,891 refugees were returned to Libyan refugee prisons in the Mediterranean by the Libyan coast guard in 2020, where, according to the European External Action Service, "sexual violence, ransom extortion, forced labour and unlawful killings" are widespread.
