A.P.Polo - "Konfrontation" - Hamburg (Germany). In everyday life, confrontation (Latin confrontare, "to be neighbouring", "to push"; Latin confrontatio, "confrontation") is a juxtaposition of mutually disruptive and initially irreconcilable statements, assertions, opinions, facts, topics or people in dispute. The different controversial statements, assertions, opinions or topics are opposed to each other in a contrary or contradictory manner. Confrontation also expresses the interrelated opposition of ideologies and values as well as the differently motivated conflict between individuals, groups and the state. Confrontation is part of communication, because different points of view must be exchanged interpersonally or through the transmission of messages. Confrontations trigger a conflict, whereby conflict management, mediation or court judgements help to overcome the confrontational situation using various methods. A typical confrontation situation occurs in court proceedings when the accused/defendant, accuser/plaintiff and witnesses face each other directly in the courtroom. At least the physical confrontation as a form of confrontation - i.e. the meeting of witnesses and the accused - is provided for in criminal proceedings, for example. These regulations require the presence of the accused during the examination of a witness by a judge and grant them their own right to ask questions. The confrontation between the accused and the witness in an adversarial hearing is intended to ensure that the credibility of the prosecution witness and the credibility of their testimony can be sufficiently scrutinised. According to the Federal Court of Justice (BGH), in certain constellations, a confrontation between the witness and the defendant may be dispensed with in criminal proceedings, for example for reasons of witness protection or if there is a fear that the witness will not tell the truth in the presence of the defendant. The police perpetrator comparison is a confrontation between various possible perpetrators and victims with the aim of identifying the right perpetrator. A real confrontation occurs in US cross-examination, which, according to Rule 611b Federal Rules of Evidence (FRE), has a strongly confrontational character and serves to uncover inadmissible witness preparation and to shake the credibility of the opposing witness. Unlike the German cross-examination of § 239, the American cross-examination is a counter-examination, an element of the right of confrontation that serves to establish the truth. It is also customary to confront a witness with a possible dissenting statement during the preliminary investigation. However, only questions relating to facts that have already been the subject of direct questioning are permitted. The aim of the disputing parties must be to resolve the conflict, as otherwise the direct confrontation may initially end by breaking off negotiations, but can resume at any time. Conflict resolution is facilitated by constructive co-operation, the use of a culture of dispute or the identification of common goals or interests. The focus is on the disputed issues, not the people representing them. A decision on the disputed issues is ultimately reached through voting, discussion leader (ordre de mufti), influence, compromise, judge, retreat, victory (strategic victory), persuasion or negotiating power.
